Opening your space to pop-ups in Cincinnati: the checklist

Suggested order.

• 1. Talk to a lawyer about your space.
• 2. Check zoning, your lease or HOA. We didn't check Cincinnati home-occupation limits (unverified), so ask the City of Cincinnati.
• 3. CHD covers the city only. Outside it, check with Hamilton County (unverified).
• 4. Restaurant or bar? Check with CHD that your licence covers a guest chef's night.
• 5. Sort your drinks plan: see Drinks below.
• 6. Ask your insurer about ticketed events. Homeowners policies exclude activity "engaged in for money or other compensation." Some policies exempt small side income; get it in writing from your insurer. ISO HO-3

• 8. Set your rental fee and deposit in writing. Good fences, good neighbours, good deposits.

Drinks

• Licensed bar or restaurant: your D permit covers only the premises on your filed sketch, and you make every drink sale. A liquor permit bans BYOB outright. ORC OAC OIU
• Joining a nonprofit's F-2: your $10 sits on top of its $150 ($160 jointly), filed 30+ days ahead. On your own premises, add an affidavit that your permit privileges won't be used. ORC DOLC
• Unlicensed space or home: no drink sales, and a drink bundled into a ticket counts as one. BYOB only for private, invite-only events with no ticket, cover or corkage. No city liquor licence found (unverified); indoor dinners need no Cincinnati event permit. ORC OIU DOLC Cincinnati

Watch-outs

• A "required donation" counts as a charge, so it doesn't get you out of licensing. ORC 3717.01
• Temporary licence food must be prepped on site or in a licensed kitchen, never at home. CHD
