Opening your space to pop-ups in Chicago: the checklist

Suggested order.

• 1. Talk to a lawyer about your space.
• 2. Check zoning: no residential or manufacturing zone can host a pop-up. Check your lease too. BACP FAQ
• 3. Get a Tier II or III pop-up host licence. Already a restaurant? Add a Shared Kitchen Supplemental licence instead ($330, 2 years). BACP BACP FAQ
• 4. Sort your drinks plan: see Drinks below.
• 5. Ask whether ticketed nights need a public place of amusement licence ($770 to $13,200). BACP flyer
• 6. Ask your insurer about ticketed events. Homeowners policies exclude activity "engaged in for money or other compensation." Some policies exempt small side income; get it in writing from your insurer. ISO HO-3
• 7. Ask the organizer for their pop-up or shared kitchen user licence and a certificate of insurance naming you. BACP FAQ
• 8. Set your rental fee and deposit in writing. Handshakes are lovely. They don't hold deposits.

Drinks

• Selling drinks: your own liquor licence, or a Chicago-licensed caterer's, whose staff pour and sell by the full bottle to the organizer. BACP Code 4-60-081
• BYOB: Chicago doesn't regulate it; you may charge corkage. Some areas ban it outside restaurants. BACP Code 4-58
• City step: in a vote-dry precinct, caterers pour only in private homes. Check your precinct with BACP first (lookup tool unverified). Code 4-60-081

Watch-outs

• Parties "become illegal when an admission fee is collected, liquor is sold or the event is advertised" without licences. BACP flyer
• A basement venue got cease-and-desist orders and faced $2,000 to $5,000 in fines after a viral Instagram video. Calling it "donations" didn't help. NBC Chicago
